It’s important to note that while a judge’s job includes saying what the law is, that does not imply that the law is anything a judge might declare it to be. If a judge is doing his job legitimately, what the law is, and what the judge says it is, will be one and the same. If the judge declares the law to be anything other than what it actually is, however, that doesn’t change what the law really is—it merely shows that the judge is not doing his job.
