No in my view it could be something like 7-2 letting the bill stand. Traditionally, conservative judges were defined as those who looked at the case, the relevant case law and the constitutional claims, and then only over turned a law if if was outside established precedent. Taxing someone based on their choice of lifestyle is something that many laws do..
