The legal argument they are likely to prevail with is this. The law does not say you must purchase anything. What the law does say is if you DONT purchase health insurance you are subject to an additional tax.

They will argue, successfully in my view, that everyone is free to decide if they want to purchase health insurance or pay the tax... Also I would not be so sure it will be a 5-4 decision....
