That image has been on the internet since the spring of 2008 and no prosecutor in the nation has launched an investigation for forgery or fraud.

Any local district attorney, any state’s Attorney General or any US Attorney where that image appeared could investigate its authenticity, but none have.

Quite a few state Attorneys General (including Hawaii’s) have independent subpoena power, meaning they don’t need a judge to issue a subpoena and Hawaii law allows confidential birth records to be released “by an order of a court of competent juridiction.” No prosecutor has subpoenaed Obama’s original birth records for comparison to the internet posted images.

As to the time of birth shown on the internet image, the St. Petersburg Times newspaper did a pretty thorough investigation of Obama’s COLB and they received their own copy of the document from the Hawaii Department of Health.

If any prosecutor in the nation were to launch a Grand Jury investigation into possible criminal charges for forgery or fraud in the posting of that image of Obama’s alleged COLB, I would be delighted to finally have the issues resolved under the rules of evidence and with expert testimony taken under oath with the threat of perjury.

St. Petersburg Times (Politifact) did not receive a copy of Obama’s COLB from HI DOH. They got their copy from Obama’s campaign and e-mailed it to Okubo who actually denied that she could confirm the authenticity of the image of Obama's COLB!

Okubo says she got a copy of her own birth certificate last year and it is identical to the Obama one we received.

And about the copy we e-mailed her for verification? “When we looked at that image you guys sent us, our registrar, he thought he could see pieces of the embossed image through it.”

Still, she acknowledges: “I don't know that it's possible for us to even say beyond a doubt what the image on the site represents.”
