I would love to sit on a grand jury. I have two friends that have served on grand juries. Both said that it was a great experience.

The only thing a grand jury can do is issue indictments - accusations. No court and no prosecutor is obliged to act on an indictment if they don't want to. The real power of the grand jury system lies in the grand jury's ability to refuse to return an indictment. Grand juries can be effective as a break on government power, but are poorly suited for political initiative.

I recall the days of self-appointed People’s Tribunals sitting in judgment on the “crimes” of Ronald Reagan and George Bush. I thought they were utter buffoons. But now FR “educates” me how Justice Scalia thinks they all the time were an independent arm of government.

Who’d have guessed, including Justice Scalia.

But won’t it get confusing when every action of every politician is declared a crime by some motley Grand Jury self-convened by the opposition ?
