The following article by Herbert W. Titus, JD, and Christine Ross first appeared in the May/June 99 issue of Life Advocate magazine. ---
The mainstream media tell us that the Supreme Court legalized abortion with its Roe v. Wade decision in 1973. The media also tell us that there is nothing we can do about it because Roe v. Wade is the law of the land.
Nothing could be further from the truth. Abortion is not legal in America! Recognition of this fact is the first step for the pro-life movement in its campaign to turn back the murderous scourge on innocent babies.
Indeed, heart disease (738,781 deaths per year) is not the number one cause of death in the United States - abortion is, at well over a million deaths per year.
Article VI of our nations founding document declares that [t]his Constitution, and the laws of the United States.. .made in pursuance thereof; and all treaties made under the authority of the United States shall be the supreme law of the land.
What is clearly missing from this Constitutional list of supreme laws is a court opinion. This was not an oversight.
Our Constitutions writers knew that a court opinion could never be law; much less the supreme law of the land. This is especially true if that court opinion contradicted the Constitution itself

Nope. They thought they were acting within the law. This won't fly.
So, you it is your view that once abortion is made illegal across the country that doctors who perform abortions and women who have abortions should not be charged with murder?
Wow, that is very troubling that you somehow believe that people should not be charged with murder for killing babies.
Your post 6: Don't forget to arrest every woman who has every had an abortion, their husbands, boyfriend, family members and friends that knew before the fact that the woman was going to have an abortion.
Your post 19: However, once Roe is overturned or the Human Life Amendment is passed, those doctors and women who conspire to murder an unborn baby will be charged with murder.
So which point do you want to debate? Actions while abortion is legal? Or if it's made illegal?
If it's legal, no one is arrested.
If it's illegal, it's against the law, right? Right.
For some reason you left out my post 17 that read:
“Yes, I understand that the premise of this thread is false in that abortion is still legal in the US.”
And I stand by what I wrote in post 19 which read:
“However, once Roe is overturned or the Human Life Amendment is passed, those doctors and women who conspire to murder an unborn baby will be charged with murder.”
Again, the premise of the thread is false, but if were true and abortion had really been illegal all of these years, than yes all those parties I mentioned would need to be arrested for murder.
Nope. It's called "acting in good faith". They relied on a court ruling. And I didn't see post 17.
“Nope. It’s called “acting in good faith”.”
So now having an abortion, conducting an abortion or conspiring murder via abortion is “acting in good faith?”
Wow.
If the law is changed, there will be no arrests as during the time Roe v Wade was in effect people thought it was legal.
Yes, I throughout this thread have said that the premise of the thread is false.
However, not knowing that an act is a violation of the law is not justification for committing such act.
So, you would agree that once Roe is overturned and or there is a Life Amendment passed, that the doctors that perform, the women that have and all that conspire with the doctor on woman to murder a child via abortion should be charged with murder?
If Roe v Wade is overturned, it will then become a state issue as it was BEFORE Roe v Wade.
That depends on what the actual decision and basis for it are.
While the most likely scenario would be to return it to the states, it is entirely possible that the Court could decide that the unborn are persons and as such enjoy full rights under the 14th Amendment. If this happens, states would not have the option of legalizing abortion for anything other than to save the life of the mother. A lot of it will depend on the actual case the Supreme Court has before them and what it addresses.
Thanks!
So, it is your state’s rights view that the State of Iowa could pass a law that permits someone to murder a four year old
child by chopping her into pieces,
Have a nice evening.
Ditto. I am counting on the sonograms to slowly change hearts and minds. The prochoicers are losing the battle to keep babies “inhuman blobs of tissue.”
It is treated as legal by governmental institutions in a way indistinguishable from anything rendered legal by a legitimate process.
Well, it’s past time for us to return to legal sanity. Thousands more helpless children were slaughtered today, and the grisly process will go on again tomorrow.
And we can’t blame it on “institutions.” It is individuals that lead those institutions who are choosing to ignore their sworn oath to protect innocent human life.
I would like to see state legislatures stand up and say, “The Supreme Court never had the authority to over-ride state laws against abortion, and so we will pass and enforce laws against abortion in out state.”
That simple.
Every branch, at every level, needs to step up and defend innocent human life.
