Ambinder Explains How Dems Could Delay Seating of Sen. Scott Brown

Yesterday, Marc Ambinder explained in answer to a question how Democrats could delay the seating of newly elected Massachusetts Sen. Scott Brown.

Q. Can Democrats really delay seating Brown?

A. Probably. There are several built-in election procedure traps, including the counting of absentee ballots and ballots from soldiers overseas. If for some reason these ballots are counted and there are no significant challenges by the seventh day after the election -- that's next Wednesday -- State of the Union Day -- then Secretary of State Bill Galvin could certify the election if he wanted to. Harry Reid, the majority leader, won't seat a senator until the secretary of state certifies him or her. But a week is too short a time frame here: under federal law, overseas votes can arrive as late as January 29. Throw in a few days for the counting of provisional ballots, and we're into early February. Then the formal certification meeting happens, which can take an extra day, depending on who is where.

After the results are received from the local election officials, the secretary of state will present the total results to the governor and the Governor's Council for certification. Only after the results are certified by the governor and the Governor's Council can a certificate of election be issued. (The governor and the council schedule their own meetings, which usually take place on Wednesdays.) . . . . . If the Dems in MA try anything funny, they will be forming the proverbial circular firing squad on themselves.

I wouldn’t put it past Billy Galvin(Sec of State in MA). He’s a slippery son of a gun.

Since Brown won buy 100,000 votes, I would think that waiting for provisional and military ballots is irrelevant. He should be seated in a week or less.

I hope they will try. They will show Mass. that they were right in the way they voted and the rest of the country will follow suit. This November will trun out to be a blood bath for the Dems.if they don’t seat Brown before they pass HC.

Kirk is NO LONGER a United States Senator and can no longer vote in the U.S. Senate.

What happened to the "law" I've been reading about that states Kirk's term ends (ended, now) with the election?

Someone needs to make an issue of this, like TODAY if he is still occupying his seat!!!

Of course to do so, first we must locate an "R" who actually has a "pair;" a daunting task, I fear!!!

In the NY 23rd election, it was held on November 3rd and HOffman conceded that night. Owens was sworn in on the 6th. The GOP should trumpet that quick turnaround if the Dems attempt any kind of delay.

It is not your opinion it is a fact. Kirks term ended at 12:00 noon yesterday, which was written in the law, by the Democrats.

If they play games seating Him then all bets are off for the Rat’s in 2010 and 2012. They will have really awakened the sleeping GOP and Independants who will become aware that the Rat party is really the Communist party or the Black Panthers who will Rape Pillage and steal an election no matter what the outcome might be. This will be the end of the Obummer era and the freak show of Harry loves Nancy.

If they try anything funny and as a result the Health Care Bill passes, I think the Second American Revolution will escalate and it will be the worst nightmare those idiots could possibly have.

Seating Brown doesn’t matter at this point folks, settle down.

House will NOT pass the SENATE version of the bill, and they WILL NOT manage to get a compromise out of reconciliation before he gets seated, and if they do, House still won’t pass it.

That’s the facts.

The 2 houses much approve the same bill, the Senate won’t pass the House bill as is, and the House won’t pass the Senate bill as is, and reconciliation even if it hammers out something, won’t be able to do it quickly and given what happened in MASS the house won’t even pass that at this point.

Democrats can try to play dirty tricks to keep Brown out of the Senate, and if they do, Brown simply shows up every day at the Senate with his truck and gets turned away, it will make great PR and political drama and get play all over the news. Day after day showing up to work “for the people of Mass” to be turned away by dirty harry.... Really??? I can’t see that being a win for the D’s in any way shape or form. Kennedy himself was seated before certified after his special election, they have seated all sorts of folks quickly... etc.

Its a lose lose for Democrats to play that game, they won’t get a bill passed, and just piss off the electorate even more. Democrats in the House will revolt and start publicly bashing Reid if he tries those games, hell even Barney Frank has said seat him. Its a completely losing proposition for Dems to play that game.

They won’t get a bill out of reconciliation that can pass anyway at this point, no bill will pass the House at this point. Fauxbama is a lame Duck, Reid is a lame Duck, Pelosi is a Lame duck, they are all politically dead people walking and everyone in DC now knows it, even if they won’t admit it.

Has nothing to do with legal certification. Only a non-legal,verbal statement. According to Barnes on FOX, certification can be made today! According to the Constitution, seating is accomplished if the candidate win the election and meets "qualifications" outlined in the Constitution. Certification is something the states have come up with.

This is all moot now, especially with Webb’s announcement that all health care votes should be suspended until Brown is seated. That was Webb’s shot across the bow of the USS Red & Pelosi. Health care is dead, irrespective of when Brown is seated.

You know, I wonder why Coakley conceded so quickly. I’m thinking she may have done it as a bit of a slap to Obama and the DNC. Sorta like “screw you guys, I’m going home”...to put an end to any shenanigans.
