Thank you. As much as I think the HOA is stupid, it existed before he moved there. Unless I’m missing something, this is the kind of thing FReepers would be blasting the guy for, say, if it involved an Obama flag. Rule is rules. Don’t like the rules, don’t move there.
As Silly pointed out, there’s nothing in the by-laws specifically prohibiting flag-poles, but only a subjective “aesthetic” clause, so your “don’t like the rules, don’t move there” is just a POS piece of advice.
My question, for saner posters in FR, is what about the HOA membership. How does that work? If the majority of people living in this housing area wanted to support Barfoot, couldn’t they get together and re-elect a new board? Or elections not on the table with HOAs? (I wouldn’t know. I’ve never “moved there”.)

Actually, it seems that there is no covenant or bylaw addressing flagpoles, and the charges are based on an obscure and subjective ‘aesthetic violation’ charge. In addition, there is a section of the Flag Code which specifically prohibits HOA’s from preventing citizens from flying the flag, so long as it is done in accordance with the proper etiquette found in the Code.
Ordinarily, I’m with you in the ‘HOA’s are stupid, but you joined it’ camp. However, in this case, it seems to be that the HOA is in violation of US code and the homeowner is in the right.
