Here is a copy of the lawsuit ACORN filed in Maryland against James O'Keefe, Hannah Giles and Breitbart.
I had to block out their address because this document had their personal addresses.
You can see exactly what they are claiming.
The Document is at link.

Firewall is blocking the link. Can you give us the gist of what it says?

They are suing for violation of Recording Laws. I am not a lawyer so my interpretation is probably not accurate.
Oh and a ridiculous amount of money. 2 Million if I am not mistaken.
Can they counter-sue? I hope they make millions
I’m sure that if they were found guilty, Andrew would pay for Hannah and James.. $2million is pocket change for him.
They are trying to get $500,000 for the two scum bags on the video. Ms. Thompson and Ms. Williams.
Isn’t it a great Country we live in when someone assist with Child smuggling and then gets to sue the person who caught them for $500,000
Lawsuit is not going to get anywhere.
In reading the statute - they indeed may be guilty - but you have to wonder about such statutes. How is 60 minutes protected from such stuff? Is freedom of the press, i.e. the first amendment going to trump this statute.
Further - the statute is likely overly broad and does step into federal jurisdiction. There is an awful lot of stuff in there (not directly applicable to this case) that has to do with the state trying to say who can and can’t listen to radio broadcasts, etc. This is something the Federal government dominated with the Communications act of 1934 and the creation of the FCC. IANAL - but it sure looks like they step on a lot of federal toes with this statute.
$2mill lawsuit is only part of the problem- what about their legal fees??
Do you know how long they have to be served? I don’t think they have been served with the lawsuit yet.
Suppose the tapes are subpoenaed and become evidence in this lawsuit. If a DA decided to press charges against ACORN for criminal acts and the defense tried to get the tapes suppressed as evidence, would the fact that they were evidence in another lawsuit in front of the court militate against suppressing them in rthe criminal case? They do seem rather d***ing.
