I believe they’re going to try KSM in a Federal District Court in NYC. That court has criminal as well as civil jurisdiction.
They are going to try KSM in Federal Court, but when they run into trouble from his lawyers, who will ask for a change of venue, or perhaps complain about the death penalty, then they will ask for a world court, which will then refuse unless they offer Bush and Cheney.
