Any decent defense attorney could turn this into a three year circus, with the US itself on trial, and reams of classified intel exposed.

And since intel is almost never of trial-quality value as evidence, then they get to get it all thrown out.

This will be a proxy trial of Bush and Cheney that Holder has wanted from the beginning. Possibly to be followed by a real trial. Except that I think enough people will be sickened by this spectacle that it may bring out a wholesale rebellion at the next election. This may bring on the most dramatic blowout in 2010 you’ve ever seen, with 2012 not far behind.

This whole thing is disgusting, and will be a HUGE distraction while it goes on and on and on.
