Actually the Secretary of the Dept of HHS declared the PREP Act on Sept 28th. Anyone that receives the swine flu and almost all other flu vaccinations cannot file suit for damages. This protects Big Pharma, distributors, hospitals and everyone authorized to give the vaccines. You are allowed to appeal but your appeal is to the Secretary of the DHHS. The US government has set a process in place that an injured party may be compensated based on expert opinion for out of pocket medical expenses, work or income lost and certain other expense's. The US government was to set up a fund for this purpose. To this date no funds have been appropriated. No punitive damages on this one. Seems they have had no problem with tort reform on this one. So much for the 7th amendment.
