FYI: ...when I found out clinton put him on the bench I was very concerned and mentioned it on FR. I was told to give the guy a break because he is a Marine. I respect all who have served our country...but even some of them may be unethical. Will read more of the thread before I make further comments. :-p

Federal law is very clear that, if you think the judge is disqualified, you have to move to recuse him before he rules. She can't wait for his decision on the motion to dismiss and then move to disqualify him-- that would permit the kind of gamesmanship where Orly could accept his ruling if she won and demand a do-over if she lost.
In fact, one of the things Judge Land sanctioned Orly for in the Georgia case was moving to disqulaify him based on his stock ownership after he ruled against her, because she knew of the stock ownership before the ruling.
