You’d have to look at the state codes to find out what all positions constitute peace officer status with powers of arrest. My guess is no. If it’s a misdemeanor or infraction to carry a sign in these circumstances or a certain kind of sign, it has to be committed in front of a peace officer or else done through citizen’s arrest. The department would have stringent rules for that situation, and the sign would not rise to that level. An arrest in this situation would have been a slam-dunk big payday lawsuit and done a lot to quell similar behavior in that neck of the woods for a long time, plus gotten Cheeks the boot. I would have liked to have had the opportunity to file.
