Obama Administration breaks federal law

President Obama and his administration are going to be facing a potential headache after a federal lawsuit was filed by a former Inspector General who was fired illegally. His name is Gerald Walpin who was the independent watchdog for the Corporation of National and Community Service. Walpin claims he was fired by the administration because he was investigating Kevin Johnson, the Democratic Mayor of Sacramento, California for misusing funds. Shortly after beginning the investigation Walpin was fired by the White House for “being disruptive,” “confused,” and “disoriented.”

Well here in lies the problem, the terms used by the White House sound suspiciously like ageism and making Mr. Walpin, who is in his seventies, sound senile. To prove them wrong, Mr. Walpin took a test on national TV and passed easily, so clearly his mental functions are intact. The crux of the lawsuit, which carries merit, is that you cannot fire an Inspector General without notifying Congress 30 days ahead of time and without talking to the Inspector General and his/her staff about the situation. None of those happened in this case, which is funny, because one of the main cosponsors of the federal law outlining these conditions was then Senator Barack Obama. Oh, and before people start assuming Mr. Walpin is a conservative and all that nonsense liberal conspiracy theorists will spin, he is not. He actually is independent, is actively pushing for Judge Sotomayor’s confirmation, and a bipartisan group of former Solicitor Generals are backing him up for his experience and independence.

This is either a case of ageism or just breaking a federal law. It seems much more likely that, while Senator Obama wanted to hold President Bush accountable with this law, he does not have to follow it. If Kevin Johnson broke the law, he should pay the consequences, not have his buddy (and yes they are friends) President Obama cover it up. Both political parties have raised concerns about this, because the law clearly was not followed and Mr. Walpin is not senile. This is just the latest example of this administration overstepping its bounds and thinking that they are just so popular, that they can do whatever they want. Well they are not that powerful and their poll numbers are slipping because people do not want their country run like this. I sincerely hope Mr. Walpin wins his case and brings to the public light how the Obama administration broke a federal law in doing so.

Add in issue of the GM and Chrysler White-Crib-Engineered bankruptcy-reorganization that obliterated each state’s franchise laws (dealers screwed). 10th Amendment count anymore?

I sincerely hope Mr. Walpin wins his case and brings to the public light how the Obama administration broke a federal law in doing so.

He may win his case, but do we really think that is going to matter after the 3 years it takes to do so?

And, as was the case for 8 long years of Clinton illegalities, 50% of the people in this country not only don't care, most of them are glad he is doing it if it helps keep the Dems in power. I've had otherwise law abiding libs tell me just that.

I didn't realize he'd filed a suit. I'd like to read the complaint.

BREAKING: Walpin-gate Lawsuit Update - Quinn Hillyer

Today, controversially fired AmeriCorps Inspector General Gerald Walpin filed suit in the United States Court for the District of Columbia demanding his job back. The named defendants n the suit are acting AmeriCorps CEO Nicola Goren, Cheif Human Capital Officer Raymond Limon, and General Counsel Frank Trinity.

I don't see a filing in the United States Federal District Court for the District of Columbia (dcd.uscourts.gov), probably due to delay in entry. The only case that NOW appears online, as filed on 7/17-18/2009, is 1:09-mj-00416-DAR -- USA v. SOTO -- filed 07/17/09

Fired inspector general files lawsuit - Washington Times

Though it's not part of the suit, Mr. Walpin's lawyers said in their legal brief that the case "raises serious questions of age discrimination" because of the accusations that Mr. Walpin, who is in his late 70s, seemed unable to function.

The suit was filed in federal district court in Washington, D.C.
