Know doubt. That dodge would be coming. However, I doubt blanket executive privilege outside the executive branch that's not pertaining to his duties would be a non-starter.

Thom Mrozek, a spokesman for the U.S. Attorney's Office, said that “the judge did make a bunch of comments about having the matter correctly and thoroughly aired, once and if they got to the merits of the actual lawsuit, which was not the subject of today's discussion."

It appears that LA times is still trying to downplay this.

It looks to me like Holder’s Justice Department is trying to downplay this if you ask me. At least the LA times put it on their blog. It’s not much, but it’s a start.

We need info on these US attorney’s.

The judge presiding over Orly's case, Judge Carter, is a former marine and seen as many as a “straight shooter”. Born in 1944, he began his legal career as an Assistant District Attorney with the Orange County District Attorney's Office in 1972, where he became the senior deputy district attorney in charge of the office's homicide division.

As a prosecutor, Carter was the initial prosecutor and filed charges in the case of serial killer William Bonin, also known as “The Freeway Killer,” who became the first person executed by lethal injection in California in 1996.

Between 2000 and 2001, Carter presided over the longest criminal trial in the history of the Central District of California. This case involved the prosecution of more than forty alleged members of the Mexican Mafia on charges of murder, attempted murder, conspiracy to murder, extortion, etc.

Just my .02, but I don't think Judge Carter is easily intimidated ...

This is a beautiful prayer.

Every day I pray that honest, capable, and strong leaders will emerge who will **defend the Constitution**. I am not the only one out there praying for this. Citizens by the millions must also be as well.

Perhaps Judge Carter will be one of those leaders that God is raising up.

Well now, isn’t this interesting about the US Attorney:

Mr. O’Brien graduated from the United States Naval Academy in 1981, and from the University of San Diego School of Law in 1993, where he was an Associate Editor of the San Diego Law Review and received his degree with honors. He has accumulated 2,000 flight hours as a Radar Intercept Officer in the F-14 “Tomcat” fighter aircraft, and is a graduate of the United States Navy Fighter Weapons (“Top Gun”) School.
