From Rachel's point-of-view, when we capture someone on the battlefieldI don't remember O saying "battlefield.....nor soldiers. My assumption is he plans to use this new "regime" of law to detail anyone that "might" be a threat in the future...but has not committed a crime.

Like someone with a conservative bumper sticker on their car. He wants to create the legal framework to lock up forever anyone who opposes him.
