If they were captured on a battlefield, they are the equivalent of POWs (or whatever you want to call them)... but they are not due the rights under the Geneva Convention... they are not fighting for a state, do not wear uniforms and are not a co-signee of the Convention.
They are most definitely NOT owed the US court / trial process. And, they should be released ONLY AFTER the war is over.
If they are caught raising arms against our troops, I personally do not care what happens to them.
