Seems to me the burden of proof lies with Barack Hussien Obama aka Barry Soetoro.

If the case actually made it to court the burden is still on the accuser to prove. But Barry has to produce counter evidence to show the accuser is wrong. Why he hasn’t done so only makes the situation escalate.
But don’t count on SCOTUS to do anything. It’s obvious they are not prepared to act.
