I would imagine they haven’t talked about it because it is a standard procedure that is the same as the other cases such as Berg and Donofrio, which were rejected. It does not indicate that Roberts agrees, or has even read the case completely. Strangely enough, Hawaii statute 338 doesn’t say what this case says that it says, so even in the best case scenario, where the court actually agreed to hear this case, it would be quickly dismissed. However, the court won’t hear this case. I would bet my 24 year pension on it.
