Yes they would. Any case can be appealed, eventually even to the Supreme Court. And once it reaches the court it has to go through procedures. It cannot be dismissed out of hand by the staff, it has to at least be reviewed by one of the Justices. That Justice can deny it or schedule it for the weekly conference. But evidence doesn't enter into the matter regardless. This is an appeals court. The case is reviewed on it's merit. So the fact that the court has bothered to look at these cases, even in a cursory manner, is no testimony to evidence or lack there of.
