it’s safe to say its unlikely the court won’t hear the case.

If it's unlikely they won't, then it's likely they will. Double negative = positive. I'm not so sure this is the meaning that the author of the blog intended, though.

It sounds like they think the court will hear the case and just because it wasn’t listed today doesn’t mean that it won’t be listed Monday. jmo
