Supreme Court Justice John Paul Stevens, the oldest and longest-serving justice on the Court, will swear in Joseph Biden as Vice-President on Jan. 20, a source close to the inaugural planners has confirmed to Legal Times. Stevens, 88, was named to the Court in 1975 by President Gerald Ford. It is rare for a vice president to be sworn in by an associate justice appointed by a president of the opposite party, so this choice can be seen as a bipartisan gesture -- though Stevens is usually regarded as one of the most liberal justices on the Court.
Stevens will swear in John McCain Jan 20th believe it or not!

I am not going to watch any of this travesty. It just better not interupt Rush’s show. Here in the CS timezone, Rush comes on liuve at 11:00 am. That’s when The One is being sworn in. Rush better be on. If not, then I’ll listen to Christmas music. that’s a much better alternative actually.
Even if Obama is disqualified this won't happen. If Obama is disqualified before the electoral college votes, the electoral collage will select the president. If he is disqualified after the EC votes, then Biden becomes the president.
By tradition (though not by law), the Chief Justice swears in the President, and the Vice President is sworn in by whichever associate justice he chooses.
Seems the MOST liberal senator, Barack Obama ought to be sworn in by the MOST liberal justice, Ruth Bader Ginsberg - perfect symmetry.
