According to Michael Stokes Paulson, a Law Professor who has written on the application of the Emoluments Clause in the past, he says this regarding the Clinton appointment:

So basically, if they lower the salary back to where it was before, then everything is hunky-dory?

Interesting premise, but these days, the Constitution, sadly, is treated more like an obstacle than a proclamation of liberty.

The Emoluments Clause of Article I, section 6 provides “No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States, which shall have been created, or the Emoluments whereof shall have been encreased during such time.” As I understand it, President Bush’s executive order from earlier this year “increased” the “Emoluments” (salary) of the office of Secretary of State. Last I checked, Hillary Clinton was an elected Senator from New York at the time.

When courts so appointed to uphold the Constitution outright ignore those duties and enter into legislative fiat, no wink or nod is appropriate; no sarcasm possible.

I guess that just leaves the natural born citizen question.

or the relevance of the 14th amendment when algore together with the florida supreme court attempted to change election law after the vote in an attempt to steal the election.

or McCain_Feingold’s trampling of the first ammendment.

Take your pick.

(or Roe v Wade, just figured this was too obvious)
