Justice Scalia has maintained there is no individual right to vote for Pres in the Const.

Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.

I am concerned too about this guy (Obama) and his possible lack of qualifications. I just dont see anyone with enough backbone or political means to do anything about it. EVEN if we had a Republican Congress, I would be concerned

OK. Now we know that Congress does not get involved until it received the certified votes from each state. This being the case I don’t understand what votes in “...the counting of such votes,...” are if not the certified votes then what votes are they? Does the quote refer to two certifications?

The VP does not become President if the President elect does not qualify but, rather, becomes Acting President “...until a president shall have qualified;....”

In 1876 they did get two sets of votes from 4 states. You would think the certified votes would be the ones counted.
The commission did go with the Republican votes.
