Yeah it just says that Obama has to respond to Cert by Dec 1. That is normal. It just means “tell me why we shouldn’t consider this appeal.” Unless he specifically asked for the BC in that response there is no need to produce it. Unfortunately, I can’t find that order. I would think that if, indeed, there was an order to produce the BC we’d have seen a copy of that pleading by now.
All Obama has to do is to respond with a standing argument because that is all that is really being appealed . . . Berg being kicked for lack of standing. If it is determined he DOES have standing then it goes back to court for a hearing.
Now it is possible that Souter has requested a BC but I am dubious. Again, I would think Berg would have that pasted all over the Net.
That was my understanding too. Obama has to respond by Dec. 1st. I don’t think he’s been ordered to produce the birth certificate. He could do the same thing he did with the lawsuit in the lower court and ask [file?] for a dismissal based on a lack of standing. I could be wrong, but that was my understanding.
