Forgive my ignorance, but why has this come to a lawsuit? Isn’t it an absolute, written-in-stone requirement of all candidates for president that they prove they’re eligible for the office according to the restrictions set out in the constitution? Somehow, it seems to me this should be a no-brainer, and the documents should have been on file throughout the past year and more.

The incoming president is sworn in by the Chief Justice of the Supreme Court. The CJ is sworn to uphold the Constitution. It is time to petition CJ Roberts that it is his sworn duty to uphold the Constitutional requirements of the president.

Again there is no legal requirement to do so.
Up until now the “honor” system” has worked.

I’m glad you are seeing the light. If.... what we are talking about here is true, then this is the biggest case of fraud ever committed on the American People by a politician and in conjunction with the approval of a legitimate political party. No one can imagine it because the lie is so big.

I hope it means jail time for Dean and “O”

Welcome to 21st Century America! It never occurred to our founders that someone would actually try to avoid that requirement of holding the office of President by simply refusing to provide PROOF of meeting the constitutional requirements of the office.

It's such an open and such case to me. If he has proof that he meets the test then he would have produced it months ago. They've done everything in their power to avoid the situation, including providing an apparently false document.

I am alarmed, very alarmed, that we have reached the point in America that this man can come this close to being President. The fact that even 10 percent of the voters would consider voting for him tells me we have a lot more serious problems than bunches of bad loans to solve if we are to continue as the greatest nation in history.

I can't find the words or phrases to describe how I feel that he is backed so many, even at the highest levels of government.

This has been a hot topic here for weeks...

To answer your question...when the controversy first started a fake “certificate of live birth” was posted on the Daily Koz, and then challenged by bloggers all over the internet, and another similar phoney document was posted on an Obama website and it has been hammered by bloggers as well. The Obama campaign got their friends at factcheck.org to say that this second posted document was examined and found authentic. The Obama campaign and the media then ignored the issue completely.

That is why Berg had to file his lawsuit. The idea was to simply say to Obama “show us the birth certificate and we will go away.”

The “certificate of live birth” is not a birth certificate, and the certificate offered was a forgery anyway.

Speculation on why Obama refuses to produce this simple document center on a few ideas....maybe he was not born in the US, but Kenya...maybe his father was not who he says he was...maybe the document might have some other embarassing information.

Berg’s lawsuit also proposes that if Obama was, in fact, born in Hawaii, there might be other issues that make him ineligible under the constitution....he moved to Indonesia as a child and surrendered his US citizenship and never re-established it...or perhaps his mother did not satisfy a more obscure requirement that she be “of age” and then having left with him to Indonesia he again lost or never really had US citizenship.

I may have the details a little off, but you can get the general idea.

Apparently not. One would think so, but I don't think a candidate about whom there was any question has ever refused to provide such proof. Not that there have been many. There certainly haven't been any with a foreign father, a mother still a teenager, who lived for several of his formative years in a foreign country with a foreign stepfather, and who magically was able to travel to a foreign country, which was not allowing anything but "official" travel into the country by Americans. Well you get the picture.

The requirement to be natural born was put in there to avoid potential foreign loyalties and influences upon the President. The Anointed One certainly has such influence, gobs and gobs of it. When it was written, it would have virtually impossible for the son of Foreign citizen *father* to be a natural born citizen, unless he was born on US soil, and in some situations, not even then.
