As set forth above, for the reasons specified, I think the Supreme Court would hold McCain is not eligible to serve as President under Article II, Sec. 1, Par. 4.
Tactically, if I were in charge and had resources to pursue the issue, I would either start and certify a multi state action seeking as a remedy to decertify all Obama's elected delegates and then attempt to consolidate with all of the actions against McCain; or I would attempt to get a state to authorize an original jurisdiction action seeking that remedy on grounds comparable to the equal protection holding in Bush v. Gore.
I think the case plays better politically if you are attacking both of them--this isn't a partisan issue; it is an American Constitutional issue.
