It doesn't matter where Obama was born. If his mother was a US citizen, then he is.
I have not been reading post about the birth certificate until this post, but is it not law that a presidential candidate be born on US soil or one of its territories....wasn't there talk about McCain not being eligible for this very reason?
What is the exact law concerning this and do they not have to prove beyond a shadow of a doubt that they meet its eligibility(has not every other president)?
No it is not embarrassing that people have hounded a topic to get straight answers when not provided, this is exactly the reason we have broken the news here so often. We have people determined to find the facts whether good or bad.
Sure, there's been talk, but your understanding of the law is incorrect. You have to be a "natural born citizen" which can either be accomplished by place of birth or by the citizenship of your parents.
The place of your birth is not determinative if it's outside the US.
These threads will get interesting when they actually start to allege that Obama WASN'T born in Hawaii and offer proof of where he was born.
But it still wouldn't matter because he's a natural born citizen because of his mother.
The fake birth certificate at KOS is interesting, but it's not really even relevant.
Of course he has to be born here!
“but is it not law that a presidential candidate be born on US soil or one of its territories”
Nope, constitution says “natural born citizen” without defining it. There are threads here where the statute, US Code, about this is discussed (I posted the statute in a thread by David but I’m too lazy right now to dig it up). Go read the statute. There are many cases where a person can be born on foreign soil and still be a citizen.
The complex part is, what’s a natural citizen?
Yes, there was. Some people had an embarassing level of ignorance about the issue and didn't realize that a U.S. military base is U.S. soil.
No Person except a natural born Citizen, or
a Citizen of the United States, at the time of the
Adoption of this Constitution, shall be eligible to
the Office of President; neither shall any Person be
eligible to that Office who shall not have attained
to the Age of thirty five Years, and been fourteen
Years a Resident within the United States
The Canal issue is irrelevant, as McCain was born of two US citizens and thus was born a citizen of the US. Somewhere there is probably a consular report of birth abroad for him, which is the equivalent of an American birth certificate for legal purposes. The problem with Obama is that we're not sure he was actually born in Hawaii. If he wasn't, and mommy was in Kenya at the time, then she as the lone US citizen wasn't enough to get him automatic citizenship upon birth due to her specific circumstances.
