I’m reading a book by Patrick O’Donnell, WE WERE ONE: SHOULDER TO SHOULDER WITH THE MARINES WHO TOOK FALLUJAH. He says that, according to the Marine’s ROE, human shields are to be considered combatants. Have you ever heard that? He doesn’t say thus was just the Fallujah ROE but maybe that’s what he meant. Just wanted to check. This was news to me.

Hate to say it, but that makes sense. It is a basic truth that you get more of what you "subsidize". After a few ruthless "human shield" casualties, it wouldn't take long for the word to spread among the insurgents that using human shields is pointless, and equally as important, it wouldn't take long for the word to spread among the populace that BEING a human shield is something to avoid at all costs.

On the other hand, let the use of human shields by insurgent fighters work once or twice, and guess what the terrorists learn? Guess what word spreads then? That's right - - USE HUMAN SHIELDS.

Okay, I issued a challenge out there to come up with some problems with the prosecution’s case for the AP reporter, then I cut-and-ran from the thread. I didn’t see any takers, so I’ll get the ball rolling.

Here’s some ideas, not necessarily the most important or lethal to the prosecution, just a start:

1. The little girl from the first house that was cleared by the Marines, Eman Walid, said she had prior knowledge of the IED that killed Lance Cpl Miguel Terrazas. “I was planning to go to school. I was about to go out of bed. I knew the bomb would explode so I covered my ears.”

2. SSGT Frank Wuterich allegedly never fired his weapon in either of the first two houses, yet is charged with 12 murders of 15 people killed in those houses. Why?

3. Twentyfour people were killed that day, only 22 murders are alleged. The missing two “murders” are from the first two houses. Why?

4. Who received the compensation money paid for the alleged 15 civilian casualties that day from the first two houses? A lawyer, Khaled Ahmed Rsayef (or Raseef) represented the relatives in the payout. He claimed in different interviews (never at the same time) that he was an uncle to the lone survivor, Safa Younis, from the second house cleared, then later he was an uncle to the two survivors, Eman Walid and her brother, from the first house. After any payoffs, he expressed extreme dissatisfaction about the amount (total of $38,000 which is a huge amount in Iraq), indicating he expected millions. On the day of the killings, a Marine doing damage assessment, noted how little emotion he showed. Strange for a guy who may have just lost 15 relatives.

There’s a start. Next? If I missed pinging anyone, woops, my bad.

I remember that the 13 year old girl that survived had three different versions of her story. I don't know if she was lying and couldn't remember the story straight or if was due to the translation. I believe it to be the former.

Number 1

There was one survivor, Safa Younis Salim, 13, who in an interview said she lived by faking her death. "I pretended that I was dead when my brother's body fell on me and he was bleeding like a faucet," she said. She said that she saw American troops kick her family members and that one American shouted in the face of one relative before he was killed.

Only 13-year-old Safa Younis lived -- saved, she said, by her mother's blood spilling onto her, making her look dead when she fell, limp, in a faint.

Townspeople led a Washington Post reporter this week to the girl they identified as Safa. Wearing a ponytail and tracksuit, the girl said her mother died trying to gather the girls. The girl burst into tears after a few words. The older couple caring for her apologized and asked the reporter to leave.

“They came in and shot all of us,” she says. “I pretended I was dead.”
