I'm siding with T'wit on this one. Michael asked the court's permission because it wasn't legal to do it when he first sought to remove it. Until then, the court was not involved. Michael is the one who initiated the legal proceedings. At least this is how I look at it.

Michael is the one who initiated the legal proceedings. At least this is how I look at it. I guess we are just discussing a technicality over the word 'lawsuit'. What would the correct term be in this case, Petition the Court? If lawsuit means to sue someone, who did he sue, initially?
