Jones, 29, the son of Prentiss Police Chief Ronald Jones, was wearing a bullet-proof vest, but a bullet from the gun of 21-year-old Cory Maye, who rented the residence, entered Jones' body just below the bottom of the vest. After being shot, Jones staggered through the house to the front of the duplex, where he met other officers. He died in a police car on the war to the hospital.

So someone is saying he was at the backdoor by himself. Sound like a showoff loner move to me. Probably didn't announce "police" ahead of time.

...On the night of December 26, the task force donned paramilitary gear, and conducted a drug raid on Smith's house. Unfortunately, they hadn't done their homework. The team didn't realize that the house was a duplex, and that Maye -- who had no relationship with Smith,-- rented out the other side with his girlfirend and 1-year-old daughter. As the raid on Smith commenced, some officers - including Jones -- went around to what they thought was a side door to Smith's residence, looking for a larger stash of drugs. The door was actually a door to Maye's home. Maye was home alone with his young daughter, and asleep, when one member of the SWAT team broke down the outside door. Jones, who wasn't armed, charged in, and made his way to Maye's bedroom. Because police believed Maye's side of the duplex was still part of Smith's residence, they never announced themselves (Note added on 12/09/05: Police said at trial that they did announce themselves before entering Maye's apartment -- Maye and his attorney say otherwise. I'm inclined to believe Maye, for reasons outlined in this post. However, even if they did, announcing seconds before bursting in just before midnight, isn't much better than not announcing at all. An innocent person on the other end of the raid, particularly if still asleep, has every reason to fear for his life.). Maye, fearing for his life and the safety of his daughter, fired at Jones, hitting him in the abdomen, just below his bulletproof vest. Jones died a short time later. Maye had no criminal record, and wasn't the target of the search warrant. Police initially concluded they had found no drugs in Maye's side of the duplex. Then, mysteriously, police later announced they'd found "traces" of marijuana and cocaine...

Note the differences.
Yes, it's hard to tell who's fibbin' from a keyboard a thousand miles away. I doubt if this is the last we hear from this case.

the Constitution was abandoned a long time ago

Not by me, or many of the folks I've known over the years who have sworn to support and defend it against all enemies, foreign and domestic. In my case I took that oath at least 3 times, and only the first time did I swear to obey orders.

You better be announcing the whole time because I am a heavy sleeper. I am going to protect my children....and if you don't announce and I don't here you and you get shot...it's not slimy...it's an accident.

Why is "announcing" relevant? What do the St. Valentine's Day massacre and the Isabella Stewart Gardner heist have in common?

Jack booted thugs who go around busting down doors should expect to get shot from time to time. And if it turns out they have the address wrong, well then their demise is perhaps regrettable (depending on your attitude toward jack booted thugs). But the shooter is blameless!

Did Maye know that the people breaking into the room were cops?

Did those air marshals who shot Rigoberto Alpizar the other day know he had a bomb? Of course not. How could they? But given the situation, they had to shoot him, rather than risk themselves and the bystanders getting suffused with supersonic carpet tacks. Of course, now we know ... no bomb, just a harmless nutcase.

So, I would say, even if Maye heard them claim to be cops, if they burst into his room with violence, he was still justified in opening up. Good shoot. Dead cop. No drugs. Wrong address. Mistakes happen. Better return to civilized police procedures!
