Yesterday and again today in the Chicago Tribune I saw the claim that all but ten of President Bush's judicial nominees had been confirmed. This is of course untrue. I emailed a letter to the Trib asking for a correction, and thought it might be convenient for other Freepers to have a list of unconfirmed nominees, since the claim that that only ten nominations were blocked is common.

If anyone sees an error or omission, please post it here.

I got my information on the circuit court nominations from http://dalythoughts.com/index.php?p=3419#comments which has this to say about their current status:

Claude A. Allen was nominated during the 108th Congress, and returned to the President due to inaction. President Bush did not renominate him to the 109th.

Miguel Estrada was nominated during the 107th and 108th Congresses. After he was filibustered, he requested his nomination be withdrawn. It was.

William Steele was nominated to the 107th. He was returned to the President, who did not renominate him subsequently.

Carolyn B. Kuhl was nominated to both the 107th and 108th, returned both times. President Bush has not renominated her.

Charles Pickering was nominated to both the 107th and 108th, and was returned both times. As with William Pryor, he received a recess appointment. Unlike William Pryor, he has not been renominated to the 109th.

In effect, these five have been defeated due to the Democrats refusing a vote.

Thomas B. Griffith– out of committee, awaiting action by full Senate.
Janice R. Brown– out of committee, awaiting action by full Senate.
William H. Pryor– out of committee, awaiting action by full Senate.
William Gerry Myers– out of committee, awaiting action by full Senate.
Henry W. Saad– stuck in Judiciary
Susan Bieke Neilson– stuck in Judiciary
David W. McKeague– stuck in Judiciary
Richard A. Griffin– stuck in Judiciary
Priscilla R. Owen– out of committee, awaiting action by full Senate.
William J. Haynes– stuck in Judiciary
Terrence W. Boyle– stuck in Judiciary

For district court, also add Fritz Rohlfing of Hawaii. He was nominated but never even had a committee hearing. The supposed reason was that Sen. Inouye (D) had a snit about not being consulted by the White House to get Inouye's blessing prior to the nomination. Rohlfing eventually withdrew his name after several years.
