I can believe it. I've been hearing about stories for years like this. Mostly they end up on the evening news where Grandpa got beaten by his drug addled offspring for his SS check.

The difference here is that the Court is enabling the abuser.

I am Rami's niece and served as his temporary conservator until Judge Kalin appointed Stubbs. I have been involved in this since the very beginning when my uncle came to my family and me for help. On October 6, 2003 he looked me in the eyes while crying and said "promise you'll help me, I'm afraid"---I made that promise to him and I refuse to go back on it. I can answer any questions anyone has because I know everything.
Not a day goes by that I don't think of my uncle and worry about his physical and mental health. I worry he thinks that we abandoned him. We know that there is a padlock on the front door of his home, so he can't go out, and that he is now on some unknown medication.
This has consumed my life and my family's for the last 19 months. My frustration is overwhelming, we need help.
Some info for clarification;
Rami was married to Robin in 2000 after he showed signs of a medical problem.
Rami told our family after he left Robin in '03 that he married her because she told him he was dying and that she would take care of him. Nobody knew of the marriage until several months after.
Rami's two adult children are from a previous marriage.
Robin has a 26 year old daughter, who lives with her, from a former marriage.
If anyone would like information on this or on all the things Robin has done to my uncle, I will reply. Thank you all for your help and concern.

Rami's case is very simple.

He does not have Alzheimers or Dementia.

He wants a divorce.

He would not want to live like this (cooped up without access to friends or family).

Oh, dorrie, so sorry about your uncle. he's in my prayers, and I've emailed at least 50 friends with a link to his site.

I emailed the social services of California yesterday, and a woman called me from there late this afternoon (I'm in Texas). She told me that Adult Protective Services should be called at 213-351-5401 and then a claim could be filed with an agency (forgot name--had to do with doctors, I think). The number she gave me was 1-800-633-2322.

Please keep us updated and let us know of anything we can do. I'll ping some more freepers here.

Can't his adult children go to a lawyer and see if they could get his marriage annulled, because she exerted undue influence and he wasn't in full sound mind, when he married her? If there is any medical evidence, it could help prove it.

Also, does anyone, other than the wife has durable power of attorney? Because if someone does, he/she could start divorce proceedings and act in his behalf by talking over his finaces, etc. Unless he revoked them, I don't think that him having a guardian would invalidate those.

Talk to a lawyer, I am not one, but it's something worth looking into.

Rami and Robin were married at Rami's home by a judge who later told us that on that day Rami was very nervous and seemed as though he did not want to go through with it. Apparently according to this judge, it took quite a while to get through the ceremony and he said it was anything but a happy occasion. No family members were present, just Robin, her adult daughter as the witness and Judge William Willett. Rami's adult children have no money and very little contact with the family, they don't seem interested.
Rami filed for a divorce/annulment a week after he left Robin, 10-16-03. Robin's attorney asked the court to suspend proceedings in that matter until the conservatorship issue was resolved,Robin had first filed for conservatorship over Rami 10-10-03 without notice to anyone. On that same day Robin was served with notice that her power of attorney over Rami was revoked and was given to me. After Robin was served with the divorce papers on 10-16-03 she transferred all Rami's real property, using a revoked power of attorney, into a trust she created that gives her complete control over everything. I petitioned for conservatorship at my uncle's request on 10-17-03 after we found out what Robin had done. She just wanted to get Rami back under her control. The first judge terminated Robin's temporary order of conservatorship when he was made aware of all she had done to Rami and appointed me. I served as Rami's temporary conservator for a year until the trial. Robin withdrew her petition for conservatorship after refusing to answer questions regarding her conduct with respect to Rami's physical condition and his estate. Judge Joseph Kalin was the trial judge and refused to allow any evidence on Robin's conduct and believed her lies. Kalin appointed Stubbs (who was chosen by Robin) as Rami's permanent conservator he makes all decisions on Rami's behalf including the decision not to go forward with the divorce, to allow Robin control over Rami's estate and to force Rami to live with Robin. The sheriff's detective who spoke to Rami shortly after he was placed back with Robin said that Stubbs is merely a "puppet" of Robin's and she clearly calls the shots. As conservator, Stubbs acts in all matters as if he were Rami.

You may want to call around, there may be some attorney, who would be willing to take it, so that you wouldn't have to pay him, unless you are able to pry Rami out of Robin's clutches.

The fact that she set up the trust with a revoked POA, should be something to start with. Also -- is your POA a "durable" POA? Other POA-s automatically become invalid, if the person who gave it to you become disabled, but durable POA-s don't. I don't know whether appointing a conservator would automatically invalidate a durable POA -- it may not, which could give you legal standing.

Also, the conservatorship info you have on the website, says that there are very definite rules about how the conservator should treat the conservatee.

I would even go and talk with the district attorney, and see, if there is enough evidence for a case to prosecute Stubbs and Robin. The advantage of this is that you wouldn't have to pay lawyers fees.

Don't give up.

Are you able to visit Rami and take him out of the house, so you could communicate with him and maybe take him to a doctor? A conservator only handles his financial affairs, but one would think you could take him to a doctor, because he must have at least Medicare.

We have contacted several attorneys who all want money to take this case.
The POA I had was durable however, Stubbs was given all power over my uncle.
We have spoken to the sheriff's dept. about prosecution of Robin but they think it's a civil matter. Even though Robin committed criminal acts they won't do anything because she is married to him. Some of the things she has done are filing adoption papers on behalf of my uncle without his consent to adopt her adult daughter indicating in the papers that her daughter is granted all rights including the right to inhereit from my uncle's estate as his natural child; Robin represented herself as an attorney(which she isn't) while in Puerto Rico to transfer my uncle's 62 acres of ocean front property into a corporation and then issuing herself the shares. (in Puerto Rico when a landowner dies his property passes to his offspring not his spouse).Forming the corp. was the only way she could get his property. Robin on her own increased antipsychotic meds, Zyprexa, (which was determined to be not only unnecessary but dangerous to a person who is not psychotic) she was giving Rami before he left her because he had refused to sign documents she was putting before him. He had signed many other documents that she placed before him telling him they were insurance papers or other than what they were, when they were actually quit claim deeds to his various properties.Robin had a will drawn that left Rami's two natural children with nothing. This is just a scratching of the surface of what she has done. Also, Robin's mother and boyfriend are involved. Her mother's name appears on one of the deeds to commercial property my uncle has owned for more than 30 years. None of this was allowed in court because Robin withdrew her petition.
Nobody is allowed to see Rami, only Robin and her family. Rami doesn't go anywhere without Robin. We recently found out that she installed a padlock on the outside of the front door. She keeps him locked in the house.A friend of Rami's tried to go to the house to see him and Robin threatened that if all these people keep trying to see Rami she will have Stubbs commit him to an institution.

We have tried APS but they are not interested if you can believe that. They are intimidated by Robin's attorneys at Holland and Knight. They even received Detective Henderson's report and just don't want to get involved even though that's their job.

The conservator has a duty to look out for Rami's best interests.

I think there have been crimes committed, which is criminal matter, not just civil matter.

I would suggest you try the LA District Attorney's Office. You can get in touch with them directly, don't need to go through the police.

You are very articulate, I would suggest you write down the sequence of events, summarizing the ones that appear to be criminal offenses -- fraud and breaking the law, on the part of Robin and the conservator, and go see someone in the DA's office.

which sounds, as if it may be free.

But I think the DA is your best bet. I think Robin and the conservator have done enough illegal things, that the DA will look into it, and probably find a lot more illegal things.

I think it's harder for you to win in a civil court, because they always give the benefit of the doubt to the spouse -- unless a criminal investigation shows criminal actions, THEN you can take a civil action.

Detective Henderson told me that he knows Stubbs is a crook,a liar and that he is Robin's "puppet" He suggested a media blitz similar to Terri Schiavo's is the best way to get results.
What's amazing is how conservators are treated as though they can do no wrong. They absolutely have a special duty to those they represent however, their conduct is rarely challenged. When it is challenged, they always know how to address issues of misconduct and the courts are reluctant to question their motives. Someone gave me a websight listing the methods used by conservators to address issues of miscoduct to protect themselves. I'll try to find it and post it for all to read, it's frightening what they get away with. Stubbs is going down that list in this case and not missing a thing.
I'm thinking of going to the Torrance police dept. Early on Robin filed a critical missing persons report with them when Rami first left her. The sheriff's dept. got involved when Torrance Memorial Hospital called them with concerns of adult dependent abuse after Rami was hospitalized on 10-6-03. That's when it became their case. I had spoken to a Torrance P.D. elder abuse detective and presented him with all the information and documents I had. We had a meeting that lasted over two hours. He was chomping at the bit to get this case and even called the sheriff's dept. They told him it was their investigation and he backed off. I think if they abandon the case Torrance would take it. By the way Detective Henderson retired, I think another reason he didn't want to go further with it.
I will contact that number you posted and see what happens. I'll try anything at this point. Thank you.
