It's very close to making "failure to confess" a crime.

I fully agree. If you look at any of my sites, Global News Matrix or Total Mind Blow, you'll see that I fully support altering his charges.

Apparently you don't understand the 5th. It doesn't mean you have the right to lie, it means you have the right to not answer.
