Klayman and Keyes to Ask Governor Bush to Grant "Pardon" to Terri Schiavo
Use of Executive Power Appropriate Under the Circumstances

MIAMI, March 23 /Christian Wire Service/ -- Larry Klayman, former Chairman of Judicial Watch and 2004 U.S. Senate Candidate in Florida and owner of The Klayman Law Firm, and Alan Keyes, former Presidential Candidate, are asking Florida Governor Jeb Bush to use the powers he has been granted by the citizens of the state of Florida, under its Constitution, to save Terri Schiavo's life.

Larry Klayman stated, "Since Governor Jeb Bush is the supreme executive power of the state of Florida, he has the right and duty to step in and, in effect, pardon Terri Schiavo from the death sentence that has been unduly placed upon her by the court system."

The Schiavo case presents a vacuum for the judicial system -- because it failed to act to save Terri's life -- and Klayman and Keyes and all
Americans that want to see justice done would like for that vacuum to be filled before it is too late.

Larry Klayman will be meeting with the General Counsel to Governor Jeb Bush at 2:00 PM, today. During this meeting, he will lay out the legal justification for Governor Jeb Bush to act, and in so doing, will present what is in effect a legal brief prepared by Alan Keyes and approved by Klayman. In addition, Klayman will request a meeting with Governor Jeb Bush, which he and Alan Keyes would attend. Klayman will stress that time is of the essence, that Terri can die at any moment.

Decries judicial arrogance in appearance on Hannity Show

On Wednesday, Mar. 23, Alan Keyes told Sean Hannity that Florida Gov. Jeb Bush is authorized by the Florida and national constitutions to intervene and spare brain-damaged Terri Schiavo from starvation.

"The governor at any point has the right to intervene," said Keyes. "And if he fails to act, he is failing to do his duty."

Unfortunately, Keyes noted, the courts have argued for years that "they are, in a sense, the makers of the law, and above the law, and that once they speak, nobody gets to do anything. That's not true."

"I think the arrogance of the courts has become pretty normal now, and the main reason is because we've allowed certain powers, including the power of judicial review, to go unchecked."

Keyes continued, "I mean, we are dealing with a branch of government that feels that there is no force in the government, whether at the state or the federal level, that can control them."

"This is wrong," Keyes said, "and is destroying the integrity of our system of constitutional self-government."

Alluding to the Terri Schiavo case, Keyes asked:

"If the executive looks at an action by the judiciary, compares it to the requirements of the Florida constitution in this case, and finds the judiciary wanting, is the executive obliged by his oath to accept that and allow the Constitution to be harmed? Or is he obliged by his oath to defend and protect the integrity of the Constitution? I think the answer is clear."

Keyes stressed that "one of the reasons, under the American system, we give executive power to a single executive--rather than to a deliberative body, or a plural executive, or some judicial-type executive (which had existed in the past)--is so that the executive can act expeditiously, and that long delay will not result in permanent and irreversible damage to the citizens or the Constitution."

He urged Gov. Bush to act quickly to save Terri.

Every governor and president has supreme executive power. It is not dangerous until it is combined with the legislative and judicial, as it has been for 50 years in the Judicial Oligarchy.

You make an interesting point...

It just seems bizarre that the police would block somebody from giving somebody a drink of water...

It was unbelievable seeing those children handcuffed by L.E.

It seems our legal system is failing so many people so many times...how long before it ultimately fails?

My chills and shivers come from the word "supreme" combined with "executive power". I have no problem with the latter alone. I do with the combination.

If I were offered the governorship of any state, Florida would be at the bottom of my list due to the court system in place there. There seems to be an inordinate amount of crisis' from that state. Jeb Bush is powerless other than to break Florida law as mandated by his courts. I don't think he has aspirations for the presidency but would like to see him run for Congress.

I wish his listeners would boycott Boortz and force him off the air because of low ratings. I never listen to him, don't believe much he says.

Gov. Jeb Bush has had the authority to save Terri all along. He has dragged it out and soon it will be too late.

He has tried before, the last time the feeding tube was in...and removed. His intervention was struck down by the US Supreme Court, I believe.

I'm thinking that these guys (Jeb Bush, 11th Circus appeal judges, congress critters, ect...)are trying too hard to "follow the letter of the law" for fear of having their actions struck down once again in the high courts, or being sued by M. Shiavo.

Very telling, especially during this Easter Triduum Jay? You bet! It's all too familiar. But I think there is more than one Pontius Pilate this time around.

This is clearly a case when "morals" and "the law" are polar opposites.

I don't think GWB's pardon power applies only to federal cases. Clinton pardoned a pedophile. And Jeb Bush can pardon Terri or place her into protective custody.

A spark of hope. I could not get through to Governor Jeb Bush's #, so I called 1-850-488-5000 (Governor's Legislative Affairs Office) and said that Governor Bush has to put Terri in protective custody NOW. They said they agreed with me, and are working on it. I told them they better hurry up; this woman is going to die.

Please call the # (1-850-488-5000), AND Governor Jeb Bush, if you can get through, or send a FAX, and tell them to please expedite, a woman is dying. Pro-death Judge Greer ordered police throughout the state not to intervene. Bully!!

We have THREE judicial branches, and they are all equal; they should not let only ONE branch rule.

Here's an e-mail I justed received from RightMarch.com, and if anyone has a fax, that might be an easier way to get through to the Bushes. Fax # listed below. If you can't get through by phone, a fax is better than and e-mail, because papers will pile up.

So here's my info from RightMarch.com:

"This is OUTRAGEOUS. Governor Bush needs to step up to
the plate NOW, and exercise his constitutional and legal
authority NOW, before Terri dies. But he doesn't seem
to be willing to take that chance and do it... so we
thought we should help encourage him.

DOES have those powers right NOW. On Thursday, we're also
bringing in Alan Keyes and Larry Klayman to try to meet with
the Governor and urge him to take Terri into protective
custody. Call Gov. Bush NOW and ask him to USE his legal
powers to save Terri's life. You can also e-mail him at
jeb@myflorida.com .

You can also call his brother, President George W. Bush, at
202-456-1414 (or fax him at 202-456-2461). Leave a message
for him that he AND his brother both have the authority to
use the police services at their disposal to take Terri into
protective custody, restore her food and hydration, and
arrest anyone who would interfere. You can also e-mail him
at president@whitehouse.gov .

For the sake of Terri's life, we CANNOT afford to wait while
the courts bicker over jurisdiction -- and we CANNOT let
little two-bit judges order the Executive branch to not do
their duty."
