Gimme a break! Gov. Bush has done everything he can to try and save Terri. To say Gov. Bush authorized an execution in this case is extreme and delusional. Terri's "husband" is the one who has authorized an execution! Even freaking Dr. Kevorkian treated his "patients" with more dignity and care than Terri has ever received. Blame Michael, not anyone else who has actually TRIED to save an innocent woman.

Ideally, I'd like to see this settled in the state of Florida.
Believing that, have these matters been considered:
1) Is Jeb Bush considered the chief law enforcement official in Florida?
2) Does the governor have the power to consider evidence of criminal actions in this case and order a criminal investigation?
3) If the governor ordered a crminal investigation, would Florida law allow the preservation of evidence - re-inserting the feeding tube?

Hey, man. As much as I'd like to see someone, ANYONE save Terri's life, I'm not sure I'd agree with this.

"...Start eating our own"??
Start?
This place is pathetic right now.
The Supreme Court will NOT take the case. They refused several times already.
The vote in Florida at 2:30Am this AM was 2-1 for NOT re-inserting the tube.
The dissenter was a Clinton appontee.
I suppose that means a lot of Freepers who think the court should not get involved should be the ones to vote for Liberal judges.
Ah! The irony.
Once again...I was right about Elian and I'm on the right side on Schiavo too.
Happily freeping since 8/98..thank you very much!

Jeb is not the fault.
He is not an absolute monarch, he is a governor.
The problem is judicial abuse and laws that can be misused and don't protect in situations like Terri's.

This thing is incredibly stupid. Gov. Bush is a Governor! He's not a Dictator. And he has pushed his legal power to the limit trying to save this woman's life.
You're wrong. Gov. Bush has not used his executive powers at all to intervene in this case. The only action he has taken has been to push the legislature.
As the state's supreme executive, he is clearly authorized to send in the National Guard if necessary. The Florida Constitution is quoted below and available online
here.
CONSTITUTION OF THE STATE OF FLORIDA
ARTICLE I DECLARATION OF RIGHTS
SECTION 2. Basic rights.--
All natural persons, female and male alike, are equal before the law and have inalienable rights, among which are the right to enjoy and defend life and liberty, to pursue happiness, to be rewarded for industry, and to acquire, possess and protect property; except that the ownership, inheritance, disposition and possession of real property by aliens ineligible for citizenship may be regulated or prohibited by law.
No person shall be deprived of any right because of race, religion, national origin, or physical disability.
ARTICLE IV EXECUTIVE
SECTION 1. Governor.--
(a)
The supreme executive power shall be vested in a governor, who shall be commander-in-chief of all military forces of the state not in active service of the United States.
The governor shall take care that the laws be faithfully executed, commission all officers of the state and counties, and transact all necessary business with the officers of government. The governor may require information in writing from all executive or administrative state, county or municipal officers upon any subject relating to the duties of their respective offices. The governor shall be the chief administrative officer of the state responsible for the planning and budgeting for the state.
(d)
The governor shall have power to call out the militia to preserve the public peace, execute the laws of the state, suppress insurrection, or repel invasion.

I have been wondering about this, I am not sure that we can hold the separation of powers doctrine all the way down the line.
It is definitely spelled out on the national level, and is based upon principles that underpin all our notions of government in this country, but I wonder if it may vary state to state or locality to locality.
I am not sure that a the chain of command goes from a local officer up to the governor the way if would from a private in the National Guard, or the way it would go from a private to the Commander in Chief in the US military.
To whom do local police answer? The courts would have us believe that they are officers of the court, particularly in any sort of custody case. IMO they are acting as executives when they send their "swarms of officers" to ensure that their will is followed, yet no one seems to be opposing this.
We need to contact the chiefs, mayors, etc to tell them not to heed the court's orders in this. Anyone have the appropriate numbers?

They talked about this on the news the other day. I think the part
"the right to enjoy and defend life and liberty"
is null because the courts have already ruled she is vegetative, which means no chance for recovery. Not that I agree with it, but Jeb can't change it.
To: MTOrlando
Thanks, I see the answer to my question about the chain of command.
I also see that he is to make sure that the laws are faithfully executed, not the judgements of the courts.

I would like nothing more than to see her husband lose his rights are her guardian, but is this the step we want to take to make this happen?I think there's a totally legitimate step Jeb Bush can take to at least temporarily take custody of Terri away from Michael Schiavo.
There have been many, many allegations of abuse of Terri by Terri's nurses and other caregivers, and by her family. Judge Greer last week flat-out refused to stay the removal of the tube pending an investigation of those allegations by DCF.
Now today, DCF is going back into Greer's court to "request" Terri's medical records --which Greer has kept sealed at Michael Schiavo's request-- so as to investigate those allegations.
I believe Jeb Bush has both moral AND legal grounds to order that the state take protective custody of Terri, especially if Greer refuses to open those records.
DCF and similar state agencies, all across our country, routinely seize custody of children or disabled persons from the legal guardians on the merest suspicion of abuse.
I hope this is Jeb's plan. I hope, and wish, and believe, that Jeb is waiting only until today to give state legislative or judicial options one last chance to do justice for Terri -- and if those options fail, he will send in state police and DCF social workers to take custody.
Politically risky? Yes. Morally correct? Of course. Legally correct? I believe, also yes.
May Jeb have the moral courage his brother George does to risk his political future to do WHAT IS RIGHT.

The way I see it, is the klintoon appointed demo-commie judge, the demo-commie-crats in Florida and the liberal feel good death agenda is to blame for this heinous ruling/act/crime against a disabled woman. This is the democrat communist manifesto in action. I would also say, if this were a convicted muderer, terrorist or any anti-american zealot, the dems would be begging for mercy to save this person. This is a civil rights issue of a disabled woman, but where is jesse and the rest of the far left who say they care for the downtroddened? NSNR

You are the kind of poster on FR that make me turn it off. It always comes down to Bush's fault. Doesn't matter what Bush just an all encompassing Bush's fault.
I would like to assume you are like those seminar callers on Rush "I'm a Republican but.....". However, your type is quite common on FR. A decision doesn't go your way and let's see how we can bash the President.I can see the future posts about how you'll never vote for a Republican again.
I have been doing everything a lone citizen can do to help Terri. I've written, called, exchanged info and prayed. I will not jump on the bandwagon for having the Bush's be the fault of Terri's condition. They have gone above and beyond for Ms. Schiavo, probably at a political cost (not that it should be a consideration).
