Well that would be the sensible and logical thing to do. Plus, it is what congress intended. So, I doubt you can expect a Clintonista Jugde to do the sensible thing. He proably has aspirations of being a Supreme Court Justice during a Hillary administration. What better way of showing your loyalty to the Clintons?

My other question is this - why does Shindler's attorney have to explain the Constitutionality of the new law - why doesn't the judge have to do that ???

While it is clever on behalf of the judge to throw this back on the Schindler's atty, in fact the atty for Schiavo did question the constitutionality of such a move. If the Schindler's atty wasn't ready on this, then shame on him and his team. Even I would have known he would have to argue that before the judge citing previous case law.

No. It seems it is open season on women, children and the disabled in this country. We allow abortions to kill babies in the womb, we allow perverts to walk freely amoung us so that they can violate children and this bastard Schiavo is being allowed to let his wife starve to death because he says"that's what she wants" and she currently does not have the ability to state otherwise. I'm personally ready to lock and load.

The fact that this Klintonista "judge" is asking for briefs on the constitutionality of the act while assiduously refusing to stop the torture and slow death of Terri strongly suggests that he is a dues paid flunkie of the DemoNazis and their culture of death. And just how, exactly, was this case docketed to a Klintonista "judge", instead of a well respected judge, righteous, wise and fair minded. Just the luck of the draw, right. Let us all pray that the forces of evil arrayed against this innocent woman are thwarted in their murderous designs.

It will be interesting to see how quickly this whole case disappears after her death.

I'm afraid I have to respectfully disagree. I expect we will see multiple mega-dollar book deals and Hollywood movie rights come of this. The money Schiavo will get from these will dwarf the piddly legal settlement money which he's probably already squandered.

Because Michael Schiavo's attorney's claim is that the law is unconstitutional. In our adversarial system, it's then up to the other party (here, the Schindlers) to put up arguments against Michael Schiavo's arguments. Remember, the judge is more like a referee in Anglo-American judicial systems (at least in theory).

It's not starving to death. It can be construed as nature taking it's course. Survival of the fittest. I know this sounds inhumane, but there are many on this forum who advocate the above except in the Schiavo case.

This is a clinton appointee, thus he will do absolutely nothing that might hurt the democraps; Terri must be put down because if she should be found more competent than a carrot, the democrats will be standing at the fifty yardline with their cloths in the endzone ... and that is an ugly sight folks. By rushing Terri to cremation, Hillary's stock only rises with brain-dead democrat voters ... [I wonder if Howard 'the duck' Dean likes my borrowing his smear?]
