In the absence of a health care surrogate document directing someone other than the spouse be the decider of health care decisions, the law automatically places that upon the husband or wife.
This stuff has happened in the past when an accident occurs during a pending divorce.

Don't get me wrong -- I'm rooting for Terri big time. However, I do have a problem with so-called conservatives who want to turn a state court issue into a Federal case. The problem here is that the so-called conservatives want the Fed or F'Duh court to overturn the Fla legislature's determination as to the evidence necessary to prove a living will.
No sir, it is not. Your position and your opinion that proceeds from it are clearly uninformed.
As it pertains to the meaning of vegitative state, and all that the term clinically implies, you have demonstrated no amount of personal clinical diagnostic accomplishment on your own part that qualifies you to make the judgment that you have carelessly made in this area. Futhermore, it is not up to any of us to do your research for you.
Do your research, make your case, and stop posting the equivalent of "I'm not a doctor in real life, I just play one on FR" kinda stuff.
In you world all old would be put to death once they could no longer sustain themselves. Think just a little. There are those who still have some semblance of a heart left who want to sustain her today. Even our founders did not kill those who needed others to suport them.
I don't have to. The court ruled she is in that state - based on expert clinical testimony. Why should your opinion or mine or anyone's outside of the experts in that court room matter?
The is the judge's job, to choose.
B) Marriage institution. The Husband is joined with the wife - if a court rules this a valid arrangement for this purpose the husband not the parents have the right to decide. We conservatives need to remember what the sacred institution of marriage means in this regard.
Holy CRAP!!! You have got to be kidding with this. The man has bought a house with the malpractice settlement that was supposed to be for lifelong treatment of Terri. On top of that, he's living with another woman, and he's had two children with her. There is no institution of marriage at this point. There are affadavits on file from nurses with him quoted as saying "is the bitch dead yet"?? He has not upheld ANY of his marriage vows to her. At what point is it valid to say, you have a conflict of interest so NO, you don't get to decide any longer. As someone who has made a poor choice in marriage in my life, let me tell you how incredibly grateful I am that he wasn't able to make any life saving decisions on my behalf. And if he had, my parents and my brothers would do exactly what the Schindlers are doing. Further if it was my daughter and I suspected that her husband had hurt her physically and put her in this position, I would do everything possible to not allow him the say. Including some kind of rescue.
You obviously speak in ignorance of someone in a brain injured status.
And finally, re-read what that idiot judge has declared. Not only that the tube is to be pulled, but that no food may be given by her mouth, which has been posted a gazillion times on this site, IF michael had spent money on therapy for his wife, instead of hiring attorney's to kill her, she could very well be able to eat on her own at this point. It was posted earlier that the attorney said she took communion so swallowing is an ability she has.
You are telling me the spouse has no rights over his wife? But the parents? What kind of conservative stance on marriage is that? The next of kin for the wife becomes the husband. Period.

The spouse who attempted to kill his wife, and CURRENTLY lives (and has lived with another woman for several years and has other children with the other woman) has or should have his rights forfeited PERIOD!
Go tell that to the court - oh wait they did and the court ruled in his favor - and only the advocates throw out the rumor that he tried to kill her to bolster their defense-providing no evidence.
If you harm your children you lose custody. If I didn't feed my dog, I would be ticketed or arrested....but it's ok for a husband who hasn't honored a single vow to starve a woman. I won't respond to any further comments from you....no man has a complete say so over the life of another.

Diogenes vainly searched ancient Greece to find an honest man. We would vainly search modern America to find a politician willing to risk his career to defy this out of control judiciary.
This statement from the HINO last time around, the whole thing just makes my blood boil! What a monster. There is no cure for Terri but her QUALITY OF LIFE could have been improved tremendously if he cared enough but obviously he doesn't. I wish I could get my hands on that monster.
Florida Law and the court upheld this says that the husband is the next of kin and they ruled thus in this case. The argument that he is not the next of kin failed.
