John Kerry's presidential campaign criticized the Cuyahoga County Board of Elections Wednesday night for its handling of the presidential recount and said some parts of that recount should be conducted again.

That won't happen.

The board certified the recount results Wednesday, which means they're official and will be forwarded to the secretary of state to be included in statewide totals.

The new numbers show Kerry beat George W. Bush 448,503 to 221,600 in Cuyahoga County. In the recount, Bush lost six votes and Kerry gained 17.

Board and staff members responded immediately to some concerns raised Wednesday night by George Taylor, a law professor at the University of Pittsburgh who lives in Cleveland Heights and who spoke, he said, on behalf of the Kerry campaign.

Taylor, for example, complained that some provisional ballots were thrown out because the signatures that voters used on Election Day were in cursive while the signatures they had on file with the board were printed. Those ballots, Taylor said, should count.

Board member Edward Coaxum said the board has always required both signatures be printed or in cursive.

Taylor also complained that some provisional ballots - ballots cast by those whose names do not appear on voter rolls - had been rejected because election workers determined voters cast them in the wrong precinct.

But Taylor said the board's own records show they were cast in the right precinct.

Cuyahoga County elections director Michael Vu had not had a chance to review those records. He will address that issue and others Taylor raised after the first of the year.

And he reminded Taylor that election regulations say only valid ballots - not those rejected - should be included in a recount.

Taylor disagreed.

"There should be a process for re-examination of every vote that was cast," he said.

2004 Democratic Presidential candidate John Kerry will file today, in the United States District Court for the Southern District of Ohio, papers in support of the Green Party/Libertarian Party recount effort. Specifically, Kerry will be filing a request for expedited discovery regarding Triad Systems voting machines, as well as a motion for a preservation order to protect any and all discovery and preserve any evidence on this matter.

Triad Systems has come under scrutiny recently after Sherole Eaton, deputy director of elections for Hocking County, swore out an affidavit in which she described her witnessing the tampering of electronic voting equipment by a Triad representative. Rep. John Conyers, the ranking minority member of the House Judiciary Committee, has requested an investigation into this matter by the FBI and the Hocking County prosecutor.

Truthout will have more on this specific Triad allegation later in the day.

Previously, the Green Party and Libertarian Party has not fared well in their efforts to get emergency orders regarding this matter in Ohio. In order to pass muster with a judge, the individual or group requesting an emergency order for such a recount must show both irreperable harm as well as a substantial chance for success on the merits. While Green and Libertarian representatives have been able to show irreperable harm, they could not establish a substantial chance for success on the merits, because no recount would deliver Ohio to either party.

Kerry's entry into this recount effort changes the math on this matter dramatically. He can likewise show irreperable harm, and unlike the Green and Libertarian candidates, he can also prove a substantial chance for success on the merits because he lost the Ohio vote by a statistical whisker.

Kerry had already filed an amicus curiae brief, I thought, a few weeks ago, anyway, for the Greens and Libertarians, in the Ohio Supreme Court.

That was thrown out. Now this is in the Federal District Court, right? Is this the difference, that Kerry is basically joining in a effort to secure some kind of evidence in little ol' Hocking County?

John F. Kerry has indicated through sources close to the Democrat party that he intends file papers supporting the Green Party/Libertarian Party recount effort in Ohio.

Kerry's filings will consist of a request for expedited discovery as it pertains to a voting machine system known as Triad Systems, and secondly, a motion for a preservation order to preserve evidence in the same matter. These filings are to be made in the United States District Court for the Southern District of Ohio.

Rep. John Conyer of Michigan and the ranking minority member of the House Judiciary Committee, has plans to ask the Federal Bureau of Investigation and a county prosecutor in Ohio today to explore "inappropriate and likely illegal election tampering" in at least one and perhaps several Ohio counties.

This follows the delivery of a sworn affidavit provided by the Hocking County deputy director of elections, Sherole Eaton, in which she alleges that a representative of Triad Governmental Systems, the Ohio firm that created and maintains the vote-counting software in dozens of Ohio counties, made several adjustments to the Hocking County tabulator last Friday, in advance of the state's recount, which is taking place this week.

Get over it. You lost. If there was evidence of fraud, Kerry would be all over it. All Kerry is doing is paying lip service to you moonbats so you don't leave the Dems. But, of course it's all part of the secret plan (wink, wink) that 99% of Democrats say there was no fraud, right? Even Michael Moore says Bush won fair and square.
