Judge? Don't presume to judge the state of your brother's soul. Do him the favor, though, of judging his actions against Scripture.
Luke 17:
3 Take heed to yourselves. If your brother sins against you, rebuke him; and if he repents, forgive him. 4 And if he sins against you seven times in a day, and seven times in a day returns to you, saying, ‘I repent,’ you shall forgive him.”
Judging your brother's actions is an act of charity; you may be God's instrument for calling him to repentance. Leave judging his soul to God.
