EU court: Google must delete inaccurate search info if asked

Google has to delete search results about people in Europe if they can prove that the information is clearly wrong, the European Union’s top court said Thursday.

The European Court of Justice ruled that search engines must “dereference information” if the person making the request can demonstrate that the material is “manifestly inaccurate.”

People in Europe have the right to ask Google and other search engines to delete links to outdated or embarrassing information about themselves, even if it is true, under a principle known as “right to be forgotten.” […]

The case stems from a complaint filed in Germany’s highest court by two managers at a group of investment companies who asked Google to remove search results based on their names that linked to articles criticizing the group’s investment model.

The pair also asked Google to remove thumbnail photos of them that came up in image searches without any context.

Google refused because it didn’t know whether the articles were accurate or not, according to a press summary of the ruling.

The court disagreed, saying that if someone submits relevant and sufficient evidence proving the “manifest inaccuracy” of the information, the search engine must grant the request.

The judges said the right to freedom of expression and information can’t be taken into account if “at the very least, a part — which is not of minor importance — of the information” turns out to be wrong. …

Search engines are useful to me when they provide references that are relevant to my queries. I can make my own judgment about the accuracy of a reference, thank you very much.

There's a huge market for a search engine that lets users block any query results from sites they don't want propaganda from.

Imagine a search engine where you can block any results from ABC, Associated Pravda, Business Insider, CNN, CBS, NBC, New York Times, Yahoo!, etc.

It could be a two-stage engine:

Step 1: Run a full query and dump all the results in a temp file on my computer so Google, Bing, or Brave don't know I'm filtering out propaganda.

Step 2: Run a query against the data dump and exclude all results posted by propaganda sites that I've selected.

Let me add to the "banned" list as needed.
Let me save different profiles so I can keep tab on the propagandists when I need to.

This is not what this is about, of course. This is about governments controlling search results.

More precisely, it's about government protecting the privacy of real people. Personal privacy is a right in Europe. Europe has a history of authoritarian fascist and communist regimes. That leads to the recognition of a right to privacy to be kept out of databases, public or private. The U.S. has been slow to protect personal privacy, and embraces Big Tech and the government sharing data, in part how they can steal elections so easily.

No, it is not a right in “Europe”. Any right not construed as a “negative liberty” is a “right” that the government can take away at will. You’ll see this in practice.
