Take the money from their endowments. The endowments are likely one thing they can't touch. The endowments would be earmarked for specific purposes and trying to use them for something like a lawsuit would negate the endowments and the money would go to another institution or back to the donors.

I think I recall Sweetbriar doing it in a big way a few years ago. Vandy did have to give back some money when they re-named a building.

Tthe court could attach the endowments itself if it wished never mind what the college was allowed to use it for legally.
