The English common law that proscribed "buggery" was part of the common law of all states via actions of the legislatures of the post-Revolutionary or newly admitted states. The harsh punishment (execution) was subsequently modified by legislation, but sodomy remained illegal in all 50 states until 1962. Under the influence of modern liberalism and its attempts to detach law from traditional morality, many states either repealed the penalty or the state courts overturned the statute. Following the Lawrence v. Texas U.S. Supreme Court ruling in 2003, the laws in the remaining states (mostly Southern or Mormon influenced) were overturned.
If a state that has sodomy laws is a theocracy, then were all 50 states theocracies prior to 1962?
