Post 331, this thread:
Jones and five other members of the caucus - including Reps. Gary Miller, R-Diamond Bar, Dana Rohrbacher, R-Huntington Beach, and Ed Royce, R-Fullerton - contend in the letter that El Paso, Texas, area Border Patrol Agents Ignacio Ramos and Jose Alonso Compean should not have been charged under the statute because carrying a firearm was a necessary part of their jobs, and that they used the firearms while on duty.
Hearing on this specific case and the "law" before the House Judiciary is scheduled for November.

Nobody got killed. You missed that part.
No need to be on the jury to understand this case.
To: A CA Guy
..makes me think they didn't report the shooting and because of the bad law to begin with. A catch-22.

Right, officers aren't above the same law they enforce. It seems that Onyx, Mike, and Dog politely put this point forward. Some folks simply ran with raw emotion, damning the President and the Governor of the State of Texas. Familiar tactic.

They probably didn't report the shooting because the criminal ran away and it would look bad on their record.

That's not what you said, though, is it?
So you've got no proof for your accusation, right?

The only error "W" made was bringin in Gonzales as Attorney General. Otherwise, this is a bunch of field BS types sucking up to their boss in DC ~ maybe looking for a promotion to a good job there that will position them for a major Eastern lawfirm at the end of the Administration in a couple of years.

I kinda doubt you are being invaded by the traveling Irish, I even doubt you have ever met one.
I don't get your point...does that make it ok for cops to do what they please?

Nobody got killed. You missed that part.Good thing. Had a person been killed, 11 years would have been too light. At any rate, people that condone and promote (potentially) deadly force for smugglers, litterbugs, and vandals in the USA might just look over their shoulder. Checks and balances are what make us great.

Look at this
posted by A.Hun:
"Because there was gunfire, the mandatory-minimum prison sentence the agents will serve is 10 years. The U.S. Probation Office in El Paso, Texas, has recommended 20 years -- 20 years away from their wives and their children, and among the type of people they've put behind bars."
Who is running the US Probation Office in El Paso recommending 20 YEARS "away from their wives and their children"?

I'm not saying they didn't make a grave error. Or that perhaps there was something else behind why they didn't report it. But - as far as we know right now, there wasn't. If so, a decade in prison is a long time for not reporting the shooting. A reprimand of some sort would've been in order - but not of this magnitude. IMO.
There seems to be more than one area of contention about this trial and sentencing...... But they were convicted on one count under the law which mandates a 10 yr sentence. Now it maybe wrong, applied erronously, needs revision, etc but that isn't what is on the books today, or according to this article. The Congress needs to address the issue as requested by some members.
[Snipped from #331} In March, an El Paso jury convicted Ramos and Compean of assault with serious bodily injury; assault with a deadly weapon; discharge of a firearm in relation to a crime of violence; and a civil rights violation.
They also were convicted of four counts and two counts, respectively, of obstruction of justice for not reporting that their weapons had been fired. The jury acquitted both men of assault with intent to commit murder.......
......The conviction for discharge of a firearm in relation to a crime of violence requires a minimum 10-year prison sentence. The sentences for the other convictions vary. On July 25, the U.S. Probation Office in El Paso recommended to Cardone that each man get 20 years.

"I ain't gonna cheer because they tried," But you'll gladly stand on the sidelines and cheer for the infiltrators while real men defend your country. Sis boom bah, patriot!

Like the Rodney King issue, had they killed the criminal, no issue.
Miss Springer of the Highway Patrol was going to shoot King dead when the LAPD insisted on taking over.
No good deed goes unpunished. A town burned, a racism wedge was widened over a felon.
Here if the border guys killed the illegal alien drug smuggler with a shot to the head, all this drama would have never happened.
