Kirk Osborn, the attorney representing Reade Seligmann, filed three motions Monday. One motion makes it very clear that he will be going after the accuser's credibility.
Seligmann, 20, is one of two Duke lacrosse players charged with raping and beating an exotic dancer at a team party March 13.
Osborn will argue that Seligmann has an alibi.
Just after Seligmann was indicted by a grand jury last week, defense attorney's released a timeline of his activities during the night of the alleged incident, including a taxi driver, ATM receipt, and a time stamp swipe into his dorm room.
The second motion goes after the accuser and her version of the alleged rape. It requests all documents relating to her criminal, mental and health history. In the motion, Osborn also requested schools and disciplinary records from North Carolina Central and her high school.
The motion explains that the alleged victim has a history of drug and alcohol abuse that existed long before the alleged attack, and challenges her credibility.
According to a confidential police report obtained by Eyewitness News, the victim and defense attorneys for Collin Finnerty are expected to file similar motions this week.
