Nothing cryptic about this; old traditionalist views of the Constitution (e.g. Thomas, possibly Scalia, possibly Alito) wouldn't see anything unconstitutional about this middle approach at all. Scalia, probably. Thomas, maybe. Two. I don't know another creationist sympathizer on the court.
