Not imaginary at all. All I was saying was that they read
the cert petition before granting cert and remanding the case. The petition and the
remand order both say the issues are the same in Stewart as in Raich and Wickard. Now, the 9th has said the same. I hope this has all helped you to figure out what "in light of" means! ;-)
