Wrong... He didn't testify in his criminal case and was found innocent. In the civil case he had to testify by law and found guilty...

Asking a question or trying to impart a little general knowledge about human nature or lessons learned could be thought of as an attack on sweet Davie Westerfield & his defenders. That would cause some of the Save Dave club to desend on you. Some of them were very civil but some were not.

As for the others, I can't answer.
For me, I went to the post office, then to the Lonestar bar, and picked up pizza and wings for dinner.
I don't have, based on the evidence, a moral certainty that Dave Westerfield is responsible for Danielle's death.
The death penalty is acceptable to me for this crime.
The punishment fits, if he is guilty; but I have grave doubts on the question of guilt.

It all depends on what you call testifying. At the conclusion of the criminal defense case, O.J. stood up at the defense table and stated that he did not kill Nicole and the other guy; that he would not have killed her and could not have killed them." The prosecution immediately demanded that O.J. get up on the stand for cross-examination. If Ito had an ounce of integrity, he would have forced O.J to get on the stand since he was testifying from the defense table. Ito's performance was a disgrace.
If O.J had been prosecuted in Santa Monica, where he lived, and the DA had not hamstrung the prosecution; O.J. would have been convicted. The prosecution in the O.J. case never had a chance.

Yes that is why I sort of lean against the DP. I certainly think some people deserve it (like Westerfield), but once you execute someone there is no correcting a mistake or deliberate misconduct by police or prosecutors. We finally agree on something. I used to be very pro-death penalty, but that was back when I actually thought that all prosecutors had the honesty and integrity one can only hope for now. Sad to say, too many prosecutors are far more interested in obtaining a conviction of anyone rather than making sure the accused actually committed the crime charged. Causes one to have a renewed respect for the criminal defense bar.

I am not anti death penalty. I think they have the wrong person convicted in this case. Ditto.

I think carenot was simply making a derisive comment about the O.J trial and how Ito allowed Cochran to hi-jack the proceedings.

I am of the impression that child molesters/killers don't last long in prison. Does anyone know if that is true or just legend ? Only in general population; folks on death row are segregated.

Have you ever been prosecuted in trial?
Did you have a lawyer?
I can tell you this. You can be not guilty. You can go to court. You can refuse a lawyer. You can defend yourself.
You will be termed an idiot. There is more to having a lawyer than being not guilty.
Only the inexperienced and immature believe that YOU DON'T NEED A LAWYER if you are NOT GUILTY.

Exactly. Judge Ito was too into his own fame. And although prosecutors get blamed for overtrying it, Judge Ito really let defense stretch out a trial that should be much faster and turned it into a circus.

May I respectfully suggest that even if you (sadly) take the view you do in the first sentence, there's no need to rush to the conclusion in the second sentence! BTW, all the prosecutors I worked with were of the highest integrity. But more importantly, juries are smart: 12 people working together can see things one person alone can't.
