The witness defined surfing, and indicated they knew what porn surfing meant. Why didn't they just s p e l l it o u t..meaning, why didn't they say someone surfed rather than saying Viewed. The reader is left with the impression that all the defense is doing is "insinuating" that someone "may have" porn surfed. They DID confirm someone looked at email around 7pm that night. But not at 5pm. See what I am saying?

Also, all of the computer "experts" in this case used the words "downloaded," "accessed," and "viewed" pretty much interchangeably.

In the strictest sense, every single thing you access that resides outside of your computer is "downloaded," as a copy of whatever it is, is moved to your computer to be displayed for you. That's what those "Temporary Internet Files" directories are for.

When normal people are talking about "downloading," though, we generally mean things like programs or collections, where you actually request the item, then wait for a full copy of it to be transferred to your computer.

You don't have to knowingly "download" something in that sense for a copy of it to be on your computer.

Doesn't matter. Neal said he wasn't looking at porn at that time. SOMEBODY did look at porn at that time, either on the internet, or inside the computer itself.

So, either Neal lied, or the police were searching DW's computer without a warrant. I don't care which of those explanations you choose, but those are the only two possible explanations.

I'm gonna be all emotional here and stuff - looking at DW while Susan L was on the stand, it's obvious that losing her messed him up. He still loves her (and I'm pretty sure she still loves him). I agree that he was trying to do stuff to help him forget.
